  • Case Assessment: Identifying the legal issues at hand, collecting evidence, and evaluating the level of risk.
  • Protective Actions: Taking immediate steps like restraining orders or notifying Adult Protective Services if necessary.
  • Legal Proceedings: Pursuing civil lawsuits for damages or referring cases to law enforcement for criminal prosecution.
  • Long-Term Planning: Helping seniors create robust estate plans and advance directives to safeguard their future.
  • Case Resolution & Follow-Up: Finalizing settlements, enforcing judgments, and providing clients with closure.

Let’s dive into “Protective Actions” – what does that stage entail?

That’s where we shift from assessment to action. Imagine a situation where an elderly individual is being financially exploited by a caregiver. In those urgent cases, we might seek a temporary restraining order to prevent further harm. We could also notify Adult Protective Services (APS), who have the authority to investigate and intervene.

If guardianship or conservatorship is deemed necessary, we’d petition the court to appoint someone trustworthy to manage the individual’s affairs.
