Ted chuckles, “It’s not exactly a quick and easy process. It involves filing a petition with the court, notifying all interested parties, and often undergoing investigations and evaluations. The court wants to be absolutely sure that a conservatorship is truly necessary before granting it.”
Let’s delve into the responsibilities of a conservator. What does that entail?
Ted leans forward, his eyes earnest. “Being a conservator is a big responsibility. You have to act in the best interests of the conservatee at all times. This means managing their finances responsibly, making decisions about their healthcare and living arrangements, and reporting regularly to the court. It’s crucial to maintain open communication with the conservatee and involve them in decision-making as much as possible.”
Ted pauses for a moment, then adds thoughtfully: “It’s not uncommon for conservators to face ethical dilemmas. For instance, balancing the conservatee’s wishes with their best interests can be challenging.”
Modifying or Terminating Conservatorship
Ted explains, “Periodic reviews are standard practice, ensuring a conservatorship remains necessary. Anyone – including the conservatee – can petition for termination if circumstances change. Maybe the individual regains capacity to make decisions independently. Or perhaps a new conservator is needed due to unforeseen circumstances.”
