An Interview with Ted Cook: Safeguarding Seniors

Hello everyone, and welcome! Today I’m thrilled to be speaking with Ted Cook, an elder protection attorney based right here in sunny San Diego. Ted, thanks for taking the time to chat with me.

What Inspired You to Focus on Elder Protection Law?

It’s a pleasure to be here. You know, I’ve always been drawn to helping those who are most vulnerable. As I gained experience in law, I realized that seniors often face unique challenges and need specialized legal guidance. It’s incredibly rewarding to advocate for them and ensure their safety and well-being.

Can You Walk Us Through the Typical Steps Involved in Elder Protection?

  • Initial Client Engagement
  • Case Assessment
  • Protective Actions
  • Legal Proceedings
  • Long-Term Planning

That’s a great question. The process can vary depending on the specific circumstances, but generally, it follows these key steps:

Let’s Dive into “Protective Actions” – Can You Elaborate on That Step?

Absolutely! Protective actions are often crucial in elder protection cases. This stage involves taking immediate steps to safeguard the vulnerable individual from further harm. For instance, we might file for a restraining order against an abuser, notify Adult Protective Services (APS) about suspected abuse or neglect, or petition the court for guardianship or conservatorship if the senior lacks capacity to make their own decisions.

“Sometimes,” Ted explains, “we need to act swiftly. I recall a case where an elderly woman was being financially exploited by her caregiver. We were able to freeze her bank accounts and prevent further unauthorized withdrawals, ultimately saving her thousands of dollars.”

>“Ted helped me navigate a very difficult situation with my aging mother. He was compassionate, understanding, and always explained things clearly. I felt confident knowing he had my mother’s best interests at heart.” – Maria S., La Jolla.

>“Point Loma Estate Planning APC was a lifesaver for our family. Ted Cook helped us set up a guardianship for my grandfather when he could no longer manage his own affairs. He made the process smooth and stress-free.” – John B., Point Loma.
