Reporter: Brenda Sanchez
Today we are joined by Steve Bliss, a renowned estate planning attorney here in Wildomar. Steve, thank you for taking the time to speak with us today.
Steve Bliss: Thank You for having me, Brenda. I’m always happy to discuss the importance of estate planning.
So, Steve, let’s dive into one of the crucial steps in the estate planning process. What are your thoughts on “Selecting an Executor or Trustee”?
Steve Bliss: Selecting a trustworthy individual or entity to manage your estate after you’re gone is absolutely vital. Consequently, it’s a decision that shouldn’t be taken lightly. This person will be responsible for carrying out the instructions outlined in your will or trust.
Ordinarily, people choose a close family member or friend whom they believe is responsible and capable. However, sometimes it makes sense to appoint a professional trustee, like a bank or trust company, particularly if the estate is complex or there’s potential for conflict among beneficiaries.
Now, I’ve had clients who initially thought choosing an executor would be straightforward. They assumed everyone in their family would agree on who should take on this role. Nevertheless, I’ve seen situations where disagreements arose, leading to tension and delays in settling the estate. This highlights the importance of open communication with your potential executors and beneficiaries beforehand.
Ultimately, you want someone who is organized, trustworthy, and has good judgment. They should also be comfortable handling financial matters and legal paperwork.
- Consider their age and health. Will they be able to fulfill the responsibilities in the years to come?
- Discuss your wishes openly with them beforehand. Make sure they understand the role and are willing to accept it.
It’s worth noting that according to a survey by Caring.com, nearly 60% of adults don’t have a will or trust in place. This underscores how many people overlook the importance of planning for their future and selecting a reliable executor.
Brenda Sanchez: That’s certainly food for thought, Steve. What a crucial point to bring up about communication and open dialogue with your potential executors and beneficiaries. Thank you for sharing that wisdom.
Steve, before we let you go, are there any parting words of advice you would like to give our viewers regarding estate planning?
Steve Bliss: Estate planning is not just for the wealthy. Everyone, regardless of their assets, should have a plan in place. It provides peace of mind knowing that your wishes will be honored and your loved ones are protected.
