Steve Bliss
Brenda, it’s a pleasure to be here. I’m always happy to discuss probate and help people understand this often-complex process.

Let’s talk about one specific step in the probate process – handling debts and taxes. Can you walk us through what that entails?
Steve Bliss
Certainly. After a loved one passes away, it’s crucial to properly manage their outstanding financial obligations. This stage typically involves identifying all valid creditor claims, meticulously reviewing each claim for accuracy, and ultimately paying those deemed legitimate.
It’s not uncommon for individuals to have debts they may not even be aware of. Accordingly, a thorough review of bank statements, credit card records, and other financial documents is essential. Moreover, we need to ensure that all applicable taxes are filed and paid, both at the state and federal levels.
This can involve estate taxes, income taxes on any income earned by the estate during probate, and potentially property taxes depending on the assets involved. Navigating this aspect of probate requires a keen understanding of tax law and meticulous record-keeping.

Have you encountered any unique challenges related to handling debts and taxes?
One case comes to mind where a client inherited a property with an unknown lien. The lien stemmed from a home improvement project completed years prior, and the paperwork had been misplaced. Discovering this lien was crucial in avoiding unforeseen financial hardship for my client during the probate process.
I worked diligently with the contractor to obtain copies of the original invoices and lien documentation. In the end, we were able to negotiate a settlement that satisfied the lien while protecting my client’s interests.

That’s quite a story! What advice would you give someone navigating this stage of probate?
Steve Bliss
My advice is simple: seek professional guidance. Probate can be incredibly complex, especially when it comes to handling debts and taxes. An experienced probate attorney can help you navigate these intricacies, identify potential pitfalls, and ensure that all obligations are met in a timely and legally sound manner.
Remember, according to the American Bar Association, over 70% of Americans don’t have a will. This can make the probate process even more challenging for loved ones left behind.
